Oklahoma Product Liability Statute of Limitations

Oklahoma law states that “A product is defective when it is not reasonably fit for the ordinary purposes for which such products are intended or may reasonably be expected to be used.” (OUJI No. 12.2)  The statute of limitations for filing a claim in product liability cases is two years following the injury that was caused by the defective product.

You could potentially have a defective product if:

  • The instructions to operate it are not clear
  • It is marketed to perform tasks it is not capable of doing
  • Its warning labels are inadequate to demonstrate its dangers
  • The harm it causes is not what you could reasonably expect from it

Oklahoma’s Product Liability Law

Modern technology, particularly devices with a lot of moving parts, can fail, causing you serious injury. The failure of even a small component can cause serious injuries through sharp edges or any number of other features. When this is the case, you could be eligible to receive compensation.

Some objects that could be the subject of a product liability suit include:

  • Cars and trucks
  • Cooking appliances
  • Medical equipment
  • Power tools
