In Oklahoma, all companies are required to carry workers' compensation insurance. An employer who carries workers' compensation insurance typically cannot be sued directly, or outside of the Workers' Compensation system, due to an employees’ injury. However, there are limited exceptions where the employer either (1) desired to bring about the worker's injury or (2) acted with the knowledge that such injury was substantially certain to result from the employer's conduct.

The statute of limitations on filing a workers' compensation claim in Oklahoma is two years, but the employee must notify the employer within 30 days of the onset of the injury or illness.
