How does workers’ compensation work in Oklahoma?
Workers’ compensation law in Oklahoma provides financial, medical and other benefits to Oklahoma workers who suffer an injury, illness or occupational disease as a result of their jobs. The statutes were created to help protect employees and their immediate families from the difficulties that arise after a work-related injury, illness or death.
Under Oklahoma law, employers must purchase workers’ compensation insurance and accept liability for work injuries regardless of fault. In most cases, employers cannot be sued for work injuries in the state’s court system.
Are there important deadlines related to workers’ comp in Oklahoma?
Employees must notify their employers within 30 days of the date of the injury or the onset of the illness. In addition, a workers’ compensation claim must be filed within two years of the date of injury or illness onset.
If you’re unsure if you are eligible for a claim, you should discuss your situation with an experienced workers’ comp lawyer as soon as possible. This will help ensure you don’t miss any filing deadlines.
What types of benefits are provided?
If you’re injured on-the-job, you may be eligible for these types of benefits:
- Payment of all medical expenses related to the injury or illness
- Temporary or permanent disability wages
- Job retraining
If a death results from a work-related injury, family members of the worker may be eligible for death benefits.
Is every Oklahoma employer required to purchase workers’ compensation insurance?
Coverage is mandated for all employers except for a few circumstances, including:
- Employers of domestic employees (such as a maid or babysitter) with a total payroll of less than $10,000 a year
- Employers of farming and ranching or other agricultural/horticultural employees with a total payroll of less than $100,000 a year
- Certain real estate agents
